Terms and Conditions for the Direct Purchase of Entry to the Czech House Paris 2024, purchases at the Czech House Paris 2024 and and Personal Data Protection Principles.

 

1. INTRODUCTORY PROVISIONS


1.1. These terms and conditions apply to the acquisition of tickets to the Czech House Paris 2024 designated for the public at the XXXIII. Olympic Games in Paris 2024, held from July 26th to August 11th, 2024, in La Villette Park, located at 59 Boulevard Macdonald, 75019 Paris, France (hereinafter referred to as the "Czech House"), within the online store located at https://www.olympijskytym.cz/ceskydum and https://www.olympijskytym.cz/czechhouse, through the interface of the website http://ceskydum.olympijskytym.cz/ (hereinafter referred to as the "reservation system") as well as for the purchase of goods, tokens and cups at the Czech House, as further defined in these terms and conditions. 

The seller, ticket provider, and operator of the online store is the company Czech Olympic, a.s., with its registered office at Benešovská 1925/6, Vinohrady, 101 00 Prague 10, ID: 25268708, registered in the Commercial Register kept by the Municipal Court in Prague under file No. B 5522 (hereinafter referred to as the "provider"). Entry ticket means a ticket with a QR code, which is either printed by the user or a PDF ticket with a QR code, presented via a portable electronic device so that the code can be properly scanned by a device located at the entrance turnstile or mobile reader (especially a mobile phone or tablet) when entering the Czech House area. 

These terms and conditions regulate, in accordance with § 1751 of Act No. 89/2012 Coll., the Civil Code, as amended, the mutual rights and obligations of the parties arising in connection with or based on a purchase contract (hereinafter referred to as the "purchase contract") concluded between the seller and another natural person (hereinafter referred to as the "user") through the provider's online reservation system for the user's entry into the Czech House area designated for the public, as well as for the purchase of goods, tokens and cups at the Czech House.

1.2. The user acknowledges that the purchase of tickets to the Czech House does not grant any rights to use registered trademarks, Olympic symbols, Olympic emblems, trade names, corporate logos, patents, or other company activities involved in supporting the Czech House, unless otherwise agreed in a specific contract.

1.3. These terms and conditions do not apply to cases where tickets are provided to the user as part of fulfilling other contractual obligations or provided free of charge to members of the Czech Olympic team under conditions specified by the provider. Deviating provisions from the terms and conditions can be agreed upon in a written purchase contract, which shall take precedence. The provisions of the terms and conditions are an integral part of the purchase contract, or the goods, cups and/or tokens in the Czech House is decisive for the user).

1.4. The provider is entitled to change or supplement the wording of the terms and conditions. New terms and conditions are effective for users upon notification at https://www.olympijskytym.cz/ceskydum and https://www.olympijskytym.cz/czechhouse. This provision does not affect the rights and obligations arising during the validity of the previous version of the terms and conditions (The version of the terms and conditions valid on the day of payment of the purchase price of the ticket is decisive).

1.5. The provider reserves the right for the reservation system not to be continuously available due to necessary maintenance of hardware or software equipment or internet outages.

2. PURCHASING TICKETS

2.1. The user is authorized to make ticket purchases without registration. However, they are required to provide their name, surname, email, and permanent address for confirmation of the online purchase. When entering the ticket details for delivery, the user must provide accurate and truthful information. The user is obligated to update any provided information in case of changes. The reservation system allows the user to purchase tickets for up to 5 (five) additional persons beside themselves, no later than 30 minutes before entering the Czech House area. The provider is not liable for incorrect data entered by the user during the conclusion of the purchase contract (name, surname, email, permanent address, date, time, and place of reservation). Each visitor to the Czech House must have a ticket for a specific day to monitor the capacity of Czech House visitors.

2.2. The user can purchase a ticket for a specific day at the Czech House via the internet and pay by quick bank transfer through the Global Payment webpay payment gateway. To make a purchase, it is necessary to provide a valid email address and valid contact details (name, surname, permanent address) in the online application. If it is possible to purchase a ticket for a child under 6 years old for free, the user must present proof entitling them to use this free ticket upon entry. In case of failure to provide evidence, the ticket is invalid. 

2.3. Before confirming the order, the buyer is allowed to review and change the information entered into the order, including correcting any errors in the data entry. The buyer submits the order to the seller by clicking the "COMPLETE ORDER WITH OBLIGATION TO PAY" button. The information entered by the user in the system is considered correct by the seller.

2.4. The user agrees to the use of distance communication means when concluding the purchase contract. The user bears the costs incurred when using distance communication means in connection with the conclusion of the purchase contract (internet connection costs,
telephone call costs), with these costs not differing from the basic rate.

2.5. Before completing the order, the user was sufficiently and timely notified of these Terms and Conditions and confirms that they have acquainted themselves with and agree to them.

2.6. The provider is not liable for any damages caused to the user due to technical failures of services provided by internet or telecommunication service providers and the relevant payment gateway. Any claims arising from such incidents must be made directly to the relevant service provider. The provider also bears no responsibility for any costs incurred by the user related to ticket purchases arising from the contractual relationship between the user and the bank that issued the user's payment card

2.7. Upon payment or confirmation of an affidavit stating that the user is entitled to a free ticket according to these terms and conditions, the user will receive an email thanking them for the purchase and containing information about the ticket/voucher in PDF format, including a QR code. The user is not entitled to ticket delivery until the full ticket price has been paid into the provider's bank account. By delivering the ticket/voucher to the email provided by the user, all provider obligations related to the purchase contract are fulfilled. Tickets are not sent by mail or cash on delivery.

2.8. By completing and finalizing the order and purchasing the ticket or receiving the ticket for free according to these terms and conditions, the user undertakes to comply with these terms and conditions, the Visitor's Regulations of the Czech House and La Villette Park, provider instructions, event management services, and generally applicable legal regulations. In the event of a breach of these obligations, the provider reserves the right to rescind the purchase contract, cancel the purchased ticket, or the ticket issued for free and claim compensation for both material and non-material damages, take measures, and assert other relevant claims arising from the violation of the aforementioned conditions and legal regulations.

2.9. Before entering the Czech House area, the user must present a ticket with a QR code in printed or electronic form on a mobile device. Entry to the Czech House will not be allowed without a ticket. The user must have a valid ticket/voucher available for the entire duration of their visit to the Czech House; if the user cannot prove their identity with a valid ticket/voucher, they may be asked to leave the premises without any compensation. The provider reserves the right to request identification from the user to verify identity based on the information provided during registration. After leaving the Czech House area, the ticket becomes invalid, and the capacity is released for other visitors. In case of failure to meet these conditions or if a person entering the Czech House exhibits clinical symptoms of an infectious disease, the provider is obliged not to admit such person to the Czech House premises. The ticket with the QR code is non-transferable, and any resale to third parties is prohibited. After leaving the Czech House premises, the ticket becomes invalid. Any tampering with the ticket renders it invalid, and the holder will not be allowed entry to the Czech House. The ticket is a valuable document, and any alterations or counterfeiting are considered offenses or crimes. DO NOT COPY THE TICKET! The ticket contains a unique QR code, which entitles entry to the Czech House premises only once and only upon first use. In case of ticket copying, the ticket holder risks not being admitted to the Czech House premises and bearing all legal consequences and damages resulting from it, regardless of whether they presented the original or a copy. The provider is not liable for any difficulties caused by unauthorized use or copying of the ticket. The validity of the ticket is governed by the opening hours of the Czech House area open to the public. The current opening hours and validity are indicated on the ticket or on the website www.olympijskytym.cz/ceskydum. The validity of the ticket also expires if it remains unused after the date indicated on the ticket. No refund is given for completely or partially unused tickets.

2.10. The user is required to arrive at the entrance to the Czech House area at least 15 minutes before the intended entry to undergo entry control.

3. PRICE OF TICKETS AND PAYMENT

3.1. The ticket price is €20.24 including VAT (twenty euros and twenty-four cents) per person aged over 6 years for ticket purchases from April 30, 2024, to June 30, 2024. The ticket price is €24 including VAT (twenty-four euros) per person aged over 6 years for
ticket purchases from July 1, 2024, to August 11, 2024. The ticket price for the opening day, July 26, 2024, is €35 including VAT (thirty-five euros) per person aged over 6 years for ticket purchases from April 30, 2024, to June 30, 2024, and €40 including VAT (forty euros) per person aged over 6 years for ticket purchases from July 1, 2024, to August 11, 2024. Children under 6 years of age (as of the day of entry into the Czech House) enter for free; the provider is entitled to verify the entitlement of the person to a free ticket upon entry.

3.2. No additional discounts apply to the prices listed on the website.

3.3. Ticket payment can be made via the Global Payment webpay gateway and is fully secured. All information is encrypted. Further information can be found at https://www.globalpayments.cz/en/terms-of-website and https://www.globalpayments.cz/en/privacy-policy.
3.4. By agreeing to these terms and conditions, the user expressly agrees that, in the case of card payment, the receipt will be sent to them electronically only, via email about the payment status. 

3.5. The provider is not responsible for any expenses incurred by the user related to ticket purchases arising from the contractual relationship between the user and the bank that issued the user's payment card.

4. WITHDRAWAL FROM THE PURCHASE AGREEMENT FOR THE PURCHASE OF TICKETS

4.1. In accordance with § 1837 letter j) of the Civil Code, the user does not have the right to withdraw from the purchase contract concluded between the user and the provider under §1829 of the Civil Code (withdrawal from the contract within 14 days of its conclusion without stating a reason), due to the fact that it concerns leisure activities and the provider's performance is provided at a specified time and reserved capacity.

4.2. The user acknowledges that the provider is entitled to cancel tickets to the Czech House for technical reasons, force majeure, current epidemiological measures, or due to the fulfillment of the Czech House's capacity. In such a case, the provider refunds the full amount to all paying ticket holders.

5. COMPLAINTS

5.1. No compensation is provided for damaged, lost, stolen, destroyed, or otherwise devalued tickets.

5.2. The provider reserves the right to change the program. Such changes do not entitle the user to a ticket/voucher refund. By purchasing a ticket, the user acknowledges this right of the provider.

5.3. The provider is not responsible if the ticket is not delivered to the user due to reasons on the user's side, especially if the ticket/voucher cannot be delivered to the specified email address (e.g., overcrowded mailbox, spam filter, etc.).

5.4. If the user does not receive the ticket within 1 hour of payment, they are required to immediately, but no later than 24 hours from the expiration of the aforementioned period when the ticket was supposed to be delivered, contact the system administrator by phone at +420 605 386 974 or by email at [email protected] and report that the paid ticket was not delivered. For these purposes, the user must provide the name, surname, and email address they provided as contact or identification information when purchasing the ticket. If the system operator/provider determines that the ticket was not delivered to the user within the specified period, the complaint period has been met, and it is not a case mentioned in the previous paragraph 5.3, the ticket will be resent to the user (if relevant to the reserved event date), or an alternative ticket for another available date chosen by the user will be provided and sent to the email address provided by the user. If the user does not choose an alternative date, the full purchase price will be refunded.

5.5. If the user's account is debited with an incorrect amount after payment for the ticket via the Global Payment webpay gateway, the user is entitled to complain about this only to the bank that issued the payment card used for the ticket (reservation) payment.

5.6. Tickets (reservations) purchased outside the provider's reservation portal cannot be complained about under any circumstances.

5.7. User complaints are processed via email at: [email protected].

6. OTHER PURCHASES IN THE CZECH HOUSE

6.1. DRINKS, CUPS, TOKENS

6.1.1 In order to minimise waste, a system of returnable, reusable cups has been introduced for measured drinks at the Czech House. The aim of the reusable cup system (hereafter referred to as "cup") is to get visitors to use the cups repeatedly. In this context, the visitor purchases a reusable cup which can be exchanged for another reusable cup after consumption. The cup is returnable.

6.1.2. Upon return of an undamaged or undefaced cup, the returning party will receive 5,-EUR (in words: five Euros) back to any credit card from which the cup was purchased; a cash refund of the cup deposit is not possible.

6.1.3. The visitor is entitled to return a maximum of ten (10) cups at a time. 

6.1.4 The possibility to return a cup will definitively expire on August 11th, 2024 at 22.00 hours.

6.1.5 The purchase of beverages in cups will only be possible using 4 (four) types of tokens, namely for the purchase of beer, soft drinks, coffee/tea, wine.

6.1.6. tokens are on sale in the value of the selected beverage in EUR including the applicable VAT.

6.1.7. The current price for individual drinks/tokens is displayed at the sales points in the Czech House.

6.1.8. The chip cannot be exchanged back for money.

6.1.9.  Drinks will be sold only in cups purchased at the Czech House.

6.1.10. The cup can be kept after the end of the Czech House. 

6.1.11. The Provider accepts no responsibility for the loss of the token and/or the cup, or for misuse by a dishonest finder.


6.2. OTHER PAYMENTS IN THE CZECH HOUSE APART FROM TICKETS

6.2.1 All payments in the Bohemian House are made only in cashless form.

6.2.2 Payments for the purchase of merchandise, cups and tokens (except tickets) will be made using the ČSOB payment gateway.

6.2.3. In the case of payment via a payment gateway, the visitor shall follow the instructions of the relevant electronic payment provider.

 

7. DATA PROTECTION PRINCIPLES, SENDING COMMERCIAL COMMUNICATIONS, AND COOKIE STORAGE

7.1. The user declares that before making a reservation or purchasing/receiving a ticket or before purchasing using a payment gateway, they have thoroughly familiarized themselves with the content of these personal data protection principles and declare their agreement with their content, committing to comply with them. By ticking the "GDPR Consent" box during electronic reservation, the user confirms their consent to these conditions. When obtaining a ticket/voucher other than by electronic reservation of the tickets, by entering the premises, the user confirms their consent to the terms of personal data processing available at www.olympijskytym.cz/ceskydum and in these conditions.

7.2. The user is hereby informed of the provider's obligations as a controller, imposed on them by Act No. 110/2019 Coll., on personal data processing, and also the rules of procedures related to personal data processing by the provider, as the operator of the Czech House in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), generally known as "GDPR."

7.3. The user expressly consents to the provider processing the provided data (name, surname, email, permanent address, phone number, and, for individuals under 6 years of age, age) solely and exclusively for the purposes of the provider's legitimate interests, for fulfilling obligations imposed by state authorities in the event of a COVID-19 illness, or with the user's consent. Personal data are processed only to the extent necessary and permissible.

7.4. The processing of the personal data specified in Article 7.3. is primarily for the purpose of enabling ticket purchase or obtaining a free ticket, for the purpose of fulfilling the contract between the provider and the user (including, for example, handling complaints), and for visitor identification (free entry control). The provided personal data are further processed for the following purposes: · communication necessary for reservation administration · improving the quality of our services · fulfilling legal obligations (e.g., under VAT law, income tax law, accounting regulations, etc.) · marketing purposes of the provider, Czech Olympic Committee a.s., ID: 25268708, or the Czech Olympic Committee association, ID: 48546607 (including taking and publishing photographs and audiovisual recordings from the Czech House, which may capture users, taken for the legitimate interest of the provider) · sending commercial communications, including offers of products and services from our and third-party companies (specifically Czech Olympic Committee a.s., ID: 25268708, or the Czech Olympic Committee association, ID: 48546607). The user therefore agrees to be included in the provider's database to be informed about its services and other events.

7.5. Personal and other data used for ticket purchase payment are provided directly to companies operating secure online payment gateways, and the provider does not have access to this data. These data are protected in accordance with the terms and conditions of the
operators of these online payment gateways.

7.6. In order to make the payment gateway available and to provide payment gateway services for the purchase of goods, cups and tokens in the Czech House, it is necessary to obtain some additional information in connection with Act No. 253/2008 Coll., on certain measures against the legalization of proceeds of crime and terrorist financing, or other information that the payment gateway operator will require from the provider. In connection with this processing, a copy of the identity card and other information to be obtained by the obliged person in connection with the identification of the visitor may also be requested. In the case of using the payment gateway for the purchase of goods, cups and tokens in the Czech House, the personal data transmitted in this context will be processed for the purpose of transferring it to the relevant bank, namely Československá obchodní banka, a. s., with registered office at Prague 5, Radlická 333/150, Postal Code 15057, ID No.: 0000135, which operates the payment gateway, for the purpose of sufficient identification and fulfilment of all obligations applicable to the provider. The legal basis is the fulfilment of the contractual obligation between the provider and the visitor, as well as the fulfilment of the legal obligations that apply to the provider in this context, or the legal obligations that apply to the bank operating the payment gateway, which the provider helps to obtain the data. Another processor of personal data is the provider of the technical solution for cashless sale of goods, cups and tokens in the Czech House - the company speedlo s.r.o., ID: 08750866.

7.7 Personal data are provided voluntarily by the user, but it is necessary to bear in mind that providing information required for contractual arrangements is necessary for their conclusion, and without them, it is not possible to provide the service in full.

7.8. Your data are safe with us. We carefully select our partners to whom we entrust your data and who are capable of providing such technical and organizational security for your data that unauthorized or accidental access to your data or its misuse is prevented. Data protection is our priority. All our partners are bound by confidentiality obligations under contract and may not use the provided data for any purposes other than those for which we have made them available. Third parties who may have access to your personal data, depending on the nature of the service you use or have used, include: · persons to whom we provide data for customer satisfaction analysis purposes; · persons who provide technical operation of certain services for us or operators of technologies we use for our services; · business partners involved in organizing our events, activities, etc.; Under certain, precisely defined conditions, we are obliged to provide some of your personal data based on valid legal regulations, e.g., to the Police of the Czech Republic and other public administration authorities. As the controller, the provider does not intend to transfer your personal data to third countries (i.e., countries outside the EU) or international organizations.

7.9. We will process personal data for the entire duration of your use of our services (i.e., for the duration of the Czech House and 14 days after its end), and subsequently, based on your consent granted for an additional 2 (two) years, unless this consent for processing personal data is revoked by you. However, we would like to inform you that personal data necessary for the proper provision of the service or for fulfilling all our obligations, whether arising from a contract between us or from generally binding legal regulations, must be processed regardless of your consent for the period specified by the relevant legal regulations or in accordance with them even after the possible revocation of your consent.

7.10. Personal Data Security: We adopt technical and organizational security measures to protect the managed data against unauthorized manipulation, loss, destruction, unauthorized access by unauthorized persons, or unauthorized disclosure. For better security of your
personal data, access to this data is password-protected, and sensitive data are encrypted during transmission between your browser and our websites.

7.11. Revocation of Consent: You can revoke your voluntarily granted consent to the processing of personal data at any time by sending an email to [email protected]. Revocation of consent does not affect the possibility of continuing to process your personal
data based on your consent given before its revocation. Revocation of consent also does not affect the processing of personal data that we process on a legal basis other than consent (i.e., particularly if processing is necessary for the performance of a contract, legal obligation, or for other reasons specified in applicable legal regulations).

7.12. Data Subject Rights: With regard to your personal data, you have the following rights in particular: · the right to revoke your consent at any time; · the right to correct or supplement personal data; · the right to request restriction of processing; · the right to object to or complain about processing in certain cases; · the right to data portability; · the right to access personal data; · the right to be informed of personal data security breaches in certain cases; · the right to erasure of personal data ("right to be forgotten") in certain cases.

7.13. Right to Object: If you no longer wish to receive occasional commercial communications or other information about news in our product and service portfolio from us, you have the option to object to further processing of your personal data for the purpose of direct marketing. If you do so, we will no longer process your data for this purpose, and we will no longer send you any further commercial communications and newsletters.

7.15. The user agrees to the storage of so-called cookies on their computer. If purchasing is enabled on the website interface without storing so-called cookies on the user's computer, the user may revoke their consent according to the preceding sentence at any time.

7.16. Furthermore, there is a contact form on the website for subscribing to the Newsletter regarding events at the Czech House, in which we collect the following personal data: email address. We store personal data from this form in order to contact you and occasionally send you the requested Newsletter. Data from this form will be used for marketing purposes only if you consent to it. This consent and its conditions for marketing use are part of the contact form. You can revoke this consent at any time by clicking on the Unsubscribe link in the footer of each Newsletter.

8. DISPUTE RESOLUTION

8.1. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID: 000 20 869, internet address: https://adr.coi.cz/cs, is competent for out-of court resolution of consumer disputes arising from the purchase contract of the tickets. The online dispute resolution platform available at http://ec.europa.eu/consumers/odr can be used to resolve disputes between the provider and the user arising from the purchase contract.

8.2. The European Consumer Centre Czech Republic, with its registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: http://www.evropskyspotrebitel.cz, is the contact point pursuant to Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC (Regulation on online dispute resolution for consumer disputes).

8.3. The provider is authorized to sell tickets based on a trade license. Trade control is carried out by the competent trade licensing office within its scope of authority. The Office for Personal Data Protection supervises the protection of personal data. The Czech Trade Inspection Authority exercises, within defined scope, supervision over compliance with Act No. 634/1992 Coll., on Consumer Protection, as amended.

8.4. The Buyer hereby assumes the risk of changes in circumstances within the meaning of § 1765 paragraph 2 of the Civil Code.

8.5. All disputes arising from the purchase of tickets through the reservation system operated by the provider will be resolved in the general courts of the Czech Republic, if not resolved out of court by agreement of the parties.

9. FINAL PROVISIONS

9.1. These terms and conditions are the only valid and binding ones for all business cases concluded between the provider and the user.

9.2. If any provision of these terms and conditions is found to be invalid or ineffective, the validity and effectiveness of the other provisions of these terms and conditions, which are separable from the invalid or ineffective provision, are not affected.

9.3. The provider reserves the right to change these terms and conditions at any time. The provider will publish the change and its effectiveness in an appropriate manner on its website www.olympijskytym.cz/ceskydum.

9.4. All provisions of these terms and conditions and the contractual relationship between the provider and the user are governed by Czech law. If the contracting party is a consumer, relationships not regulated by these terms and conditions are governed by Act No. 89/2012 Coll., the Civil Code, as amended, and Act No. 634/1992 Coll., on Consumer Protection, as amended. If the contracting party is not a consumer, relationships not regulated by these terms and conditions are governed by Act No. 89/2012 Coll., the Civil Code, as amended.

9.5. If the relationship established by the purchase contract contains an international (foreign) element, the parties agree that the relationship is governed by Czech law.

9.6. The choice of law under this article of the terms and conditions does not deprive the consumer of the protection afforded to him by the provisions of the legal order from which there can be no derogation by contract and which would otherwise apply in the absence of a choice of law under Article 6(1) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I).

9.7. The purchase contract, including the terms and conditions, is archived by the seller in electronic form and is not accessible.

9.8. These terms and conditions take effect on 22nd July 2024.
